Terms & Conditions

These Terms & Conditions ("Terms") govern your purchase and use of the software products and services offered by Hubits Pvt Ltd. They include our Refund and Cancellation Policy, Delivery Policy, Privacy Policy and payment security statement. Please read them before you subscribe. If anything is unclear, contact us first — we would rather answer a question than resolve a dispute.
1. Who we are
The Services are provided by Hubits Pvt Ltd, a private limited company incorporated in the Republic of Maldives. In these Terms, "Hubits", "we", "us" and "our" mean Hubits Pvt Ltd.

2. Interpretation
In these Terms:
- "Bank" or "Banks"
- means Maldives Islamic Bank (MIB) and/or Bank of Maldives (BML) — the licensed Maldivian banks through which Hubits accepts card payments and provides the Gateway Services. Hubits uses both. Where these Terms refer to "the Bank", they mean whichever Bank processes the transaction in question.
- "Customer", "you", "your"
- means the business that subscribes to the Services, and any staff you authorise to use them.
- "End Customer"
- means a person who pays you — for example a diner or shopper — for your own goods or services through the Gateway Services.
- "Gateway Services"
- means the payment gateway integration Hubits provides within the Services so that you can accept card and bank payments from End Customers through your own Merchant Account (section 10).
- "Merchant Account"
- means your own merchant facility with a Bank, held in your business's name, accessed with credentials the Bank issued to you.
- "Services"
- means the Hubits software products, Gateway Services, onboarding, support and documentation described in section 4.
- "MVR" and "USD"
- mean Maldivian Rufiyaa and United States dollars respectively.
3. Acceptance of these Terms
By creating an account, starting a trial, subscribing, making a payment, or otherwise using the Services, you confirm that you have read, understood and agree to be bound by these Terms. Where you are asked to tick a box or click a button to accept these Terms before paying, doing so is your affirmative acceptance of every policy on this page.
If you are accepting on behalf of a business, you confirm that you have authority to bind that business, and "you" means the business. If you do not agree to these Terms, do not use the Services.
4. The Services
Hubits provides cloud-based business software delivered as a subscription, including Foodops (restaurant operations and online ordering), Hubits Finance, Hubits People, Hubits Sales and Hubits Shops, together with related onboarding, support and documentation (the "Services").
The Services are provided on a subscription basis and are accessed over the internet. We may improve, add to, modify or retire features from time to time. Where a change materially reduces the functionality you pay for, we will give you reasonable notice.
5. Eligibility and accounts
- You must be at least 18 years old and able to enter into a binding contract.
- You must provide accurate, complete and current registration and billing information and keep it up to date.
- You are responsible for safeguarding your credentials and for all activity under your account, including activity by staff you invite. Tell us immediately at support@hubits.io if you suspect unauthorised use.
- We may refuse, suspend or close an account that breaches these Terms or that we reasonably believe presents a fraud, security or legal risk.
6. Free trial
Where we offer a free trial, its length and any conditions are stated at signup. A trial may require a valid payment card on file; a small verification hold may be placed and released. Unless you cancel before the trial ends, your subscription converts to a paid plan and the first subscription fee is charged automatically. We will remind you by email before a trial converts.
One trial per business. We may withdraw or change trial offers at any time; this does not affect a trial already in progress.
7. Pricing, currency and payment
- Prices. Plan prices are shown on our pricing pages. Prices are quoted in United States dollars (USD) for reference.
- Transaction currency. Your card is charged in Maldivian Rufiyaa (MVR). The exact MVR amount, including the conversion from any USD-quoted price, is shown to you before you confirm payment. Your card issuer may apply its own exchange rate or fees for cards not denominated in MVR.
- Billing cycle. Subscriptions are billed in advance, monthly, and renew automatically at the end of each billing period until cancelled.
- Taxes. Applicable taxes, including Maldives Goods and Services Tax (GST) where it applies, are shown before you confirm payment.
- No surcharge. We do not add any fee for paying by card.
- Receipts. We email a receipt for every charge, including each renewal.
- Price changes. We may change plan prices with at least 30 days' notice by email. The new price applies from your next billing period after the notice period.
- Failed payments. If a renewal payment fails we will retry and notify you. If payment is still unsuccessful, we may suspend the Services until the balance is settled (see section 21).
Payment methods accepted
Card payments are processed by our Banks (see section 2, Interpretation). Cards enrolled in Verified by Visa or Mastercard Identity Check may be asked to authenticate with their card issuer during checkout.
8. Refund and Cancellation Policy
Please read this before you purchase. Hubits is a subscription service delivered electronically; nothing physical is shipped and nothing is returned or exchanged.
Scope. This policy applies to subscription fees you pay to Hubits. It does not apply to payments your customers make to you through the Payment Gateway Services — those are governed by your own policies (section 10).
- You can cancel at any time. Cancel from your account settings or by emailing support@hubits.io. Cancellation takes effect at the end of the billing period you have already paid for, and you keep access until then.
- No refund of the current period. Subscription fees already paid are not refunded, in whole or pro-rata, when you cancel. You will not be charged again after cancellation.
- Trial conversions. If you did not cancel before a trial ended and were charged, the same policy applies; cancel to stop future charges.
- Billing errors. If you believe you were charged in error — for example a duplicate charge or a charge after cancellation — contact support@hubits.io within 30 days of the charge and we will investigate and correct genuine errors, refunding to the original payment card.
- Our right to refund. Nothing here prevents us from issuing a refund at our discretion.
This policy is shown to you before purchase and again when you accept these Terms at checkout.
9. Delivery Policy
The Services are delivered electronically. Access to your subscription is provisioned to your account automatically on successful payment — normally within minutes — and confirmed by email. No physical goods are delivered and there are no shipping charges.
Special conditions: onboarding, data migration, training or hardware setup, where offered, are scheduled separately and described in writing at the time of purchase. Hubits does not sell or ship hardware; any point-of-sale hardware is sourced by you and subject to its manufacturer's terms.
10. Payment Gateway Services for your customers
Two different payment relationships. Sections 7 to 9 cover what you pay Hubits. This section covers what your End Customers pay you through the gateway we provide. They are governed by different terms and different policies.
- We provide the integration; you provide the merchant account. Hubits offers the Gateway Services as a technology service. To use them you connect your own merchant account with a Bank, using the credentials that Bank issued to you, in your organisation settings. We store those credentials encrypted and use them only to create, confirm and settle transactions on your instructions.
- You are the merchant of record. Every payment an End Customer makes through the Gateway Services is a transaction between you and that End Customer, processed by your Bank under your Merchant Account. Hubits is not a party to that transaction, does not receive or hold the funds, and is not the seller of the goods or services being paid for.
- Your policies govern those payments. Refunds, cancellations, exchanges, delivery and the handling of End Customer data for those transactions are governed by your own refund, cancellation, delivery and privacy policies — not by sections 8, 9 or 14 of these Terms. You warrant that you have published those policies, that they comply with your Bank's merchant agreement and the card-scheme rules, and that you will give us their locations on request. You are responsible for honouring them.
- What you must show your End Customers. Before an End Customer pays you through the Gateway Services, you must show them: your trading name and contact details as the seller; your refund, cancellation and delivery policies; and the notice in section 11 of these Terms, or a link to it. Where your Bank or the card schemes require the End Customer to accept those terms before paying, you are responsible for obtaining that acceptance.
- If you do not, we may switch it off. If you have not published the policies you warrant above, or do not show your End Customers what this section requires, we may suspend the Gateway Services for your organisation — on notice where circumstances allow, and immediately where a Bank or card scheme requires it. Your other Services are unaffected. This is a right we hold, not a check we perform on your behalf: we do not review, approve or monitor your policies, and it remains your responsibility to have them.
- Disputes, refunds and chargebacks are yours. Requests from End Customers for refunds, and any chargebacks or disputes raised through the card schemes, are handled between you, your End Customer and your Bank. Hubits will provide the transaction records we hold to help you respond.
- Your obligations. You agree to comply with your Bank's merchant agreement and the card-scheme rules that apply to you; to keep your Merchant Account credentials confidential and tell us at once if they are compromised; to use the Gateway Services only for lawful sales of your own goods and services; and to ensure the order details and amounts you submit are accurate.
- Hubits' role and responsibility. For End Customer data flowing through the Gateway Services, Hubits acts as your service provider and processes it only on your instructions (section 14). We never receive or store End Customer card numbers — those are handled by the Bank. The availability of the Gateway Services depends on the Bank's systems, which we do not control. To the fullest extent permitted by law, Hubits is not liable for the acts or omissions of any Bank, for any End Customer transaction, refund, chargeback or dispute, or for your compliance with your Bank's or the card schemes' rules, and you agree to indemnify us against claims arising from them.
- Fees. Any merchant fees, settlement terms or charges of your Bank are between you and your Bank. Any Hubits fee for the Gateway Services is stated in your plan or agreed with you in writing.
11. If you are a customer of a business that uses Hubits
This section is for you if you have bought something from a restaurant, shop or other business and paid through a screen or payment link powered by Hubits or Foodops. The rest of this page is an agreement between Hubits and that business, and does not apply to you. This section does.
- The business you are paying is the seller, not Hubits. Your purchase is a contract between you and that business. Hubits provides the software that business uses to take your order and to start your payment — nothing more. We are not the seller, we are not the merchant, we do not receive or hold your money, and we are not a party to your purchase.
- Your payment goes to the business's own bank account. The payment is processed by that business's own bank, under that business's own merchant account, in that business's name. Your card details are entered on the bank's secure page and are never received or stored by Hubits.
- The business's policies apply — not ours. Refunds, cancellations, exchanges, delivery and collection are governed by that business's own policies, which it is required to publish and show you before you pay. Sections 8, 9 and 14 of this page describe Hubits' policies for businesses that subscribe to us, and do not apply to your purchase.
- If something goes wrong, start with the seller. For a refund, a missing or incorrect order, a delivery problem or a question about what you were charged, contact the business you bought from. They hold the order, the money and the decision. If you cannot resolve it with them, raise it with your card issuer or bank, which can open a dispute or chargeback on your behalf. Hubits cannot refund you, reverse a payment, or decide a dispute between you and the business — not because we will not, but because we hold neither the funds nor the merchant account.
- What we can do. If the business asks us, we will provide the transaction records we hold so they can investigate. If you contact us at support@hubits.io we will tell you which business the payment relates to and pass your message on, but we cannot act on your purchase ourselves.
- Your information. When you order or pay, we handle your order details and the contact details you give — on that business's instructions, as its service provider. The business decides what is collected and why, under its own privacy policy. How we protect it is described in section 14. We do not sell your information and we never see your full card number.
- Keep your records. Please keep your receipt or payment confirmation, and a note of the business you bought from. It is what a bank will ask for first if you need to raise a dispute.
Nothing in this section takes away any right you have under the law of the Republic of Maldives, or any right you have against the business you bought from.
12. Payment security
- Card details are entered on the Bank's secure page, not ours. When you pay, you are handed to a payment page hosted by the Bank, or your card details are encrypted in your browser using the Bank's public key before transmission. Either way, Hubits never receives, processes or stores your full card number, expiry date or security code.
- Encrypted in transit. All pages and payment traffic use HTTPS (TLS). Payment data is transmitted only to the Bank's PCI DSS-compliant systems.
- Cardholder authentication. Transactions are protected by 3-D Secure (Verified by Visa / Mastercard Identity Check) where your card supports it.
- Saved cards. If you choose to save a card for renewals, we store only a payment token issued by the Bank. A token cannot be used to reconstruct your card number.
- Access controls. Payment and billing systems are restricted to authorised personnel, protected by authentication and logged.
13. Your transaction records
We recommend that you retain a copy of every transaction receipt, your subscription confirmation, and the version of these Terms and policies in force when you purchased. The current version is always available at hubits.io/terms and the effective date and version number appear at the top of this page.
14. Privacy Policy
The information we collect
- Account and contact data — name, business name, email address, phone number, postal address, role.
- Billing data — plan, invoices, payment status, and a bank-issued payment token if you save a card. We do not collect or hold full card numbers.
- Business data you enter — for example menus, orders, inventory, staff records, customers, invoices and accounting entries.
- Usage and technical data — log-ins, device and browser type, IP address, pages and features used, and error reports, collected to keep the Services secure and working.
- Support communications — messages you send us and our replies.
- End Customer data via the Gateway Services — transaction references, amounts, status and the contact details your customers provide when paying you. We process this on your instructions, as your service provider; you are responsible for it under your own privacy policy (section 10).
Why we collect it and how we use it
- To provide, operate, secure and support the Services you subscribe to.
- To take payment, issue receipts, detect fraud and meet our legal and accounting obligations.
- To communicate with you about your account, renewals, changes to the Services or these Terms, and to respond to support requests.
- To improve the Services using aggregated, de-identified usage data.
- To send product news, only where you have opted in; you can unsubscribe at any time.
Who we share it with
We do not sell your information. We share it only with service providers who help us run the Services — reputable cloud infrastructure providers for hosting and backups, our Banks for card payments, and email delivery providers — each bound to handle it only on our instructions. We may also disclose information where required by law or to protect the rights, safety or property of Hubits, our customers or others.
How we protect cardholder and personal information
- Card details are handled entirely by the Bank's PCI DSS-compliant systems; they never enter Hubits systems (section 12).
- All data is encrypted in transit (TLS) and at rest.
- Access to customer data is restricted to authorised personnel on a need-to-know basis, protected by authentication and access logging.
- Production systems are monitored, patched and backed up; backups are encrypted.
- If we become aware of a breach affecting your personal information, we will notify you without undue delay and tell you what happened and what we are doing about it.
Retention, your rights and cookies
We keep your data for as long as your account is active and as needed afterwards to meet legal, tax and accounting obligations, then delete or anonymise it. You may ask us at any time to access, correct, export or delete personal information we hold about you by emailing support@hubits.io. We will respond within 30 days.
Our websites use only the cookies needed to keep you signed in and to keep the site secure and working; we do not use advertising cookies.
15. Acceptable use
You agree not to, and not to allow others to:
- use the Services for anything unlawful, fraudulent or harmful, or in breach of any third party's rights;
- attempt to gain unauthorised access to the Services, other customers' data or our systems, or to probe, scan or test their vulnerability without our written consent;
- interfere with the Services' operation, or introduce malware or automated traffic that degrades them for others;
- copy, resell, sublicense, reverse engineer or build a competing product from the Services except as the law expressly permits;
- use the Services to process card payments in any way other than through the payment methods and Gateway Services we provide.
16. Your data and content
You own the business data you enter into the Services. You grant us a licence to host, process, back up and display it solely to provide the Services to you. You are responsible for having the right to enter it — including your own customers' and staff's personal information — and for complying with the laws that apply to it.
On termination you may export your data through the Services' export features for 30 days, after which we may delete it in the normal course of operations (section 21).
17. Intellectual property
The Services, including all software, designs, text, graphics, logos and documentation, are owned by Hubits Pvt Ltd or its licensors and are protected by copyright, trademark and other laws. These Terms grant you a limited, non-exclusive, non-transferable right to use the Services for your business during your subscription. Card brand marks shown on this site are the property of their respective owners and indicate the payment methods we accept.
18. Availability and support
We aim to keep the Services available around the clock and will give advance notice of planned maintenance where practical. Occasional downtime for maintenance, upgrades or events outside our control may occur. Where an outage is caused by us and is prolonged, we will consider a service credit on request.

19. Limitation of liability
The Services are provided "as is" and "as available". To the fullest extent permitted by law, we exclude all implied warranties, and we are not liable for any indirect, incidental, special, consequential or punitive loss, or for loss of profit, revenue, business, goodwill or data, arising from your use of or inability to use the Services.
Our total liability to you for all claims arising out of or relating to these Terms or the Services in any 12-month period will not exceed the fees you paid us in that period. Nothing in these Terms limits liability that cannot lawfully be limited.
20. Indemnity
You agree to indemnify Hubits against claims, losses and reasonable costs arising from your breach of these Terms, your unlawful use of the Services, or the data and content you (or your users) enter into them.
21. Suspension and termination
- By you. Cancel at any time as described in section 8.
- Suspension for non-payment. If a renewal payment fails and remains unpaid after our reminders, we may suspend access until payment is made. Your data is retained during suspension.
- By us for cause. We may suspend or terminate your access immediately if you materially breach these Terms, create legal or security risk, or where required by law.
- Data after termination. You have 30 days to export your data, after which it may be permanently deleted. Any Merchant Account credentials you connected for the Gateway Services are deleted on termination. Sections that by their nature should survive — including payment obligations, intellectual property, liability and governing law — survive termination.
22. Changes to these Terms
We may update these Terms from time to time. For material changes — including any change to pricing, the Refund and Cancellation Policy, or the Privacy Policy — we will notify you by email at least 30 days before they take effect and update the effective date and version number at the top of this page. Continued use of the Services after the effective date constitutes acceptance. If you do not agree, cancel before the change takes effect.
23. Governing Law and disputes
These Terms and any dispute arising from them or the Services are governed by the laws of the Republic of Maldives. The courts of Malé, Republic of Maldives have exclusive jurisdiction, and you and Hubits submit to that jurisdiction.
